This statement informs you which personal data we process when you visit this website and when you send an enquiry, what we use them for and which rights you have. In short: we use the details from the enquiry form exclusively to handle your enquiry, i.e. for follow-up questions, our offer and the collection or delivery. We do not sell data and do not use them for advertising without your consent.

2. Shop system and hosting (Shopify)

This website runs on the Shopify shop system. Our contractual partner is Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. On our behalf, Shopify processes the data arising when the website is accessed and when enquiries are made, on the basis of a data processing agreement (Art. 28 GDPR). Data may be transferred to Canada and the USA in the process. For Canada, an adequacy decision of the European Commission exists; for transfers to the USA, Shopify relies on the EU-US Data Privacy Framework and the standard contractual clauses of the European Commission. Details can be found in Shopify's privacy policy at shopify.com/de/legal/datenschutz.

3. Server log data when visiting the website

Each time a page is accessed, Shopify processes technically necessary data: IP address, date and time, page accessed, amount of data transferred, browser type and version, operating system and the previously visited page (referrer). These data are required to deliver the website, to ensure its security and to detect errors. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in secure operation). Log data are deleted or anonymised by Shopify after a short time.

4. Cookies and consent

We set technically necessary cookies without consent (§ 25(2) no. 2 TDDDG, German Telecommunications Digital Services Data Protection Act): for example, they store your enquiry list, your language setting and your cookie choice. All other cookies and similar technologies, in particular for audience measurement (analytics) and marketing, are only set with your consent under § 25(1) TDDDG and Art. 6(1)(a) GDPR. On your first visit, we ask you via the cookie notice. "Accept" and "Decline" are given equal weight there; under "Manage preferences" you can choose individually. Without your choice or after "Decline", only the necessary cookies are set.

You can withdraw your consent at any time with effect for the future: via the "Cookie settings" link at the bottom of every page or by deleting the cookies in your browser; the notice will then appear again.

Cookie Purpose Type Duration
_shopify_essential, _shop_app_essential Session, enquiry list, security, cookie choice necessary session up to 1 year
localization Language and country necessary 1 year
_shopify_analytics Audience measurement by Shopify (page views, device type, origin), only with consent analytics up to 1 year

_shopify_marketing Stores whether you have allowed marketing cookies; we currently do not use any advertising networks marketing up to 1 year

5. Enquiry via the enquiry list and the enquiry form

When you send us an enquiry, we process the details you enter: name, email address, optionally your company name and phone number, your choice between collection and delivery, your message and the requested items with sizes and quantities. We use these data exclusively to handle your enquiry: for follow-up questions, our offer with price and availability, arranging an appointment for collection and processing if you accept the offer. The legal basis is Art. 6(1)(b) GDPR (pre-contractual steps and performance of a contract); if you enquire as a business, additionally Art. 6(1)(f) GDPR.

The enquiry is transmitted via Shopify's contact form as an email to our mailbox info@akkaya-bauelemente.de and handled there. If no contract is concluded, we delete the enquiry no later than six months after the last communication. If a contract is concluded, we retain the related documents (offer, invoice, correspondence) for six to ten years in accordance with the retention periods under commercial and tax law (§ 257 HGB, German Commercial Code; § 147 AO, German Fiscal Code). A customer account is not required for an enquiry.

6. Contact by email or phone

If you contact us directly by email or phone, we process your details to handle your request (Art. 6(1)(b) or (f) GDPR). Deletion and retention follow section 5.

7. Customer account

If Shopify creates a customer account at your request (sign-in by email code), we process the data stored there to provide the account (Art. 6(1)(b) GDPR). You can have the account deleted at any time; to do so, send us an email.

8. Audience measurement (Shopify Analytics)

With your consent, Shopify analyses for us how the website is used (page views, origin of visitors, device type, time spent). We only see the analysis in aggregated form. The legal basis is Art. 6(1)(a) GDPR in conjunction with § 25(1) TDDDG. Without consent, no audience measurement takes place. In addition, with your consent we use Google Analytics 4 (see section 9). We currently do not use advertising services such as the Meta Pixel; should this change, we will update this statement and the cookie notice.

9. Web analytics with Google Analytics 4

With your consent, we use Google Analytics 4, a web analytics service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). We use it to understand which pages and products are visited, what visitors look for using our shop search and how many enquiries reach us, in order to improve our range and website.

Which data. The following are recorded: page views, products viewed, search terms from the shop search, the sending of an enquiry (only the fact that an enquiry was sent, never your name, email address, phone number or message), information on device and browser, the approximate origin of visitors and the page you came from. To recognise you within your visit and on subsequent visits, Google sets the cookies "_ga" and "_ga_<ID>". According to Google, no IP addresses are logged or stored when data are collected in Google Analytics 4. We do not use Google signals or the advertising features of Google Analytics; there is no link to Google Ads.

Legal basis and withdrawal. The legal basis is your consent under Art. 6(1)(a) GDPR in conjunction with § 25(1) TDDDG, which you give via the cookie notice. Without your consent, Google Analytics is not loaded and no data are sent to Google. You can withdraw your consent at any time with effect for the future: via the "Cookie settings" link at the bottom of every page. The lawfulness of the processing carried out until then remains unaffected.

Storage period. User-level and event-level data stored in Google Analytics are automatically deleted after 2 months. The cookies "_ga" and "_ga_<ID>" have a standard duration of 2 years; browsers may delete them earlier. Aggregated reports that do not contain personal data may exist for longer.

Processing on our behalf (processor) and transfer to third countries. Google processes the data on our behalf on the basis of a data processing agreement (Art. 28 GDPR, "Google Ads Data Processing Terms"). Data may be transferred to the USA in the process. According to its own statement, Google is certified under the EU-US Data Privacy Framework, for which the European Commission has adopted an adequacy decision (Art. 45 GDPR); in addition, the standard contractual clauses of the European Commission apply (Art. 46 GDPR).

Further information. Google's privacy policy is available at policies.google.com/privacy. If you do not want your data to be used in Google Analytics, you can install the browser add-on to deactivate Google Analytics.

10. Fonts, images, videos, maps

Fonts and images are delivered via Shopify's servers, not via Google Fonts or other third-party providers. The directions video is also hosted by Shopify. The "Route to the warehouse" link leads to Google Maps; only when you click it do you leave our website, and Google's privacy policy applies.

11. Links to social networks

The Facebook and Instagram icons are simple links. No plugins of the networks are embedded, and no data are transferred to these networks when you visit our website. Only when you click a link do the terms of the respective provider apply.

12. Recipients and disclosure

Only the parties that need your data to handle your enquiry receive it: Shopify as processor, our email provider, in the case of delivery the commissioned freight forwarder (name, address, phone number for delivery) and, if a contract is concluded, our accounting and invoicing software and our tax adviser to the extent required by law. Data are not disclosed for advertising purposes or sold. With your consent, Google Ireland Limited also receives data for web analytics (section 9), as a processor.

13. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). You can withdraw any consent given at any time with effect for the future (Art. 7(3)). For all requests, an email to info@akkaya-bauelemente.de or a letter to the address in section 1 is sufficient.

You also have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen), Kavalleriestraße 2-4, 40213 Düsseldorf, www.ldi.nrw.de.

14. Data security

The connection to this website is encrypted via TLS (recognisable by the padlock symbol in the browser). Shopify operates the systems with up-to-date technical and organisational security measures. Access to enquiries in our mailbox is restricted to the persons who handle them.

15. No automated decision-making

We do not make decisions based solely on automated processing of your data and do not carry out profiling.

16. Changes

We update this statement when our processing or the legal situation changes. The version published here with the date stated above applies.
